Terms of Service

These Terms of Service ("Terms") govern your access to and use of merrycornerz.com (the "Site") and any purchase you make through it. The Site is operated by AUREVIA BEAUTY LLC, a Colorado limited liability company ("merrycornerz", "we", "us"). By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. By ordering you confirm that the payment method you use is yours or that you are authorized to use it.

2. The Site and its content

We try to describe our products accurately, including measurements, materials and colors. Screens render color differently and small manufacturing variations occur, so an item may differ slightly from the photograph. If an item is not as described, our Returns & Refunds Policy applies.

We may change products, prices and content on the Site at any time without notice. We are not obliged to update information that has become out of date, except where the law requires it.

3. Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges that we received it; it is not acceptance. The contract is formed when we dispatch the item. We may decline or cancel an order, in whole or in part, where:

the item is out of stock;
a price or description was listed in error;
we cannot deliver to the address given;
we suspect fraud, resale or abuse of our returns policy.

If we cancel an order you have already paid for, we refund you in full to the original payment method.

4. Pricing, tax and duties

Prices are in U.S. dollars and do not include sales tax; where applicable, sales tax is calculated and shown at checkout. Import duties are included in the product price and are not collected again at delivery. Shipping is $7.95 and free on orders of $60.00 or more after discounts.

Pricing errors do happen. If an item's price is obviously wrong, we will contact you before shipping and give you the choice of paying the correct price or cancelling for a full refund.

5. Shipping and delivery

Orders are dispatched from our partner warehouse in China, with an estimated total delivery time of 11-17 business days, and are delivered to the 48 contiguous U.S. states and Washington, D.C. only. Delivery estimates are estimates, not guarantees. Full terms are in our Shipping Policy, which forms part of these Terms.

Risk of loss passes to you on delivery to the address you provided.

6. Returns

Our Returns & Refunds Policy forms part of these Terms. Nothing in these Terms limits any right you have under applicable consumer protection law.

7. Accounts

If you create an account you are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe it has been used without your permission.

8. Acceptable use

You agree not to use the Site to break the law, to scrape or copy it systematically, to interfere with its operation or security, to submit false information, or to place orders for fraudulent resale.

9. Intellectual property

The merrycornerz name, logo, site design and original copy are owned by AUREVIA BEAUTY LLC. Product photography and product information are supplied by our suppliers and used with their permission. You may not copy or republish content from the Site for commercial purposes without written consent. If you believe content on this Site infringes your rights, email us and we will investigate and remove it where the complaint is valid.

10. Third-party services

The Site is hosted by Shopify and payments are processed by Stripe. Carriers (USPS, FedEx) deliver your order. Each of these is an independent company with its own terms and privacy practices.

11. Disclaimers and limitation of liability

The Site is provided "as is". To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. To the fullest extent permitted by law, our total liability arising out of or relating to your use of the Site or any order is limited to the amount you paid for the order concerned, and we are not liable for indirect or consequential loss.

Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent that jurisdiction permits. Nothing here excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify AUREVIA BEAUTY LLC against claims arising from your breach of these Terms or your misuse of the Site.

13. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules. Disputes are subject to the courts located in Colorado, except where applicable consumer law gives you the right to bring a claim where you live.

14. Changes

We may update these Terms. The revised version takes effect when posted on this page with an updated date, and applies to orders placed after that date.
